1. Agreement
These Terms form a binding agreement between Glam Labs, operator of The Tech Pad (“The Tech Pad”, “we”, “us” or “our”), and the person or organization using the Service (“Customer”, “you” or “your”). By creating an account, connecting a business asset or using the Service, you agree to these Terms and our Privacy Policy. If you act for an organization, you confirm you can bind it.
2. The Service
The Tech Pad provides business messaging tools, including WhatsApp Business Account connection, contacts, conversations, message transmission, templates, APIs, webhooks and team access. Features may change as the Service develops. Some functionality depends on Meta, WhatsApp, telecommunications networks and other third parties we do not control.
The Tech Pad is an independent technology provider operated by Glam Labs. We are not WhatsApp, Meta, WATI, Gupshup or Wassenger and do not make representations on their behalf.
3. Accounts and security
- You must provide accurate information, be at least 18 and have authority to use connected assets.
- You are responsible for credentials, users, roles, API keys, webhooks and workspace activity.
- You must notify us promptly of suspected unauthorized access.
- We may suspend access to address security, abuse, non-payment or legal risk.
4. Messaging responsibilities
You are responsible for recipients, messages, templates, campaigns and customer relationships. You must obtain and document required consent or other lawful basis; honor opt-outs and deletion requests; use approved templates when required; respect WhatsApp’s customer-service window; and comply with privacy, consumer-protection, marketing and anti-spam laws and Meta/WhatsApp policies.
You may not use purchased, scraped or unlawfully obtained contact lists.
5. Acceptable use
You must not use the Service for spam, fraud, threats, harassment, deceptive content, malware, illegal goods or infringement. You must not bypass security or rate limits, probe another customer’s data, misappropriate credentials or tokens, resell unauthorized access, misrepresent affiliation with Meta or use the Service in a way likely to damage third-party systems.
6. Customer data
You retain rights in data you submit and grant us the limited rights needed to host, process, transmit, secure and support it. You confirm you have the rights, notices and permissions necessary for us and Meta to process the data as instructed. Each workspace is logically isolated. Our processing is described in the Privacy Policy.
7. Third-party services
Use of Meta and WhatsApp is also governed by their terms. Third parties may change APIs, pricing, limits, policies, approval status or availability. We may modify the Service to remain compatible and are not responsible for a third party’s suspension, rejection, outage or policy decision.
8. Plans, fees and taxes
Paid plans, usage charges, limits and billing periods are described on the order or pricing page. Unless stated otherwise, fees exclude taxes and are non-refundable except where required by law. Meta or carrier charges may apply separately. Future pricing changes will apply with reasonable notice and will not retroactively alter a prepaid period.
9. Intellectual property
Glam Labs and its licensors retain rights in the Service, software, design, documentation and The Tech Pad branding. These Terms grant only a limited, revocable, non-exclusive right to use the Service. Feedback may be used without restriction or compensation, but we will not identify you publicly without permission.
10. Suspension and termination
You may stop using the Service and request deletion. We may suspend or terminate access for material breach, abuse, legal requirements, security risk, platform restrictions or non-payment. On termination, your right to use the Service ends; provisions that by nature should survive will survive.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties and do not guarantee message delivery, recipient response, Meta approval, phone-number quality, campaign results or uninterrupted third-party availability.
12. Limitation of liability
To the maximum extent permitted by law, Glam Labs will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profits, revenue, goodwill, data or opportunity. Our aggregate liability will not exceed fees paid to The Tech Pad during the three months preceding the event giving rise to the claim. These limits do not apply where prohibited by law.
13. Indemnity
You will defend and indemnify Glam Labs and its personnel against third-party claims arising from your messages, contacts, customer data, violation of law or platform policies, infringement, or misuse of the Service, to the extent permitted by law.
14. Governing law
These Terms are governed by the laws of India. Courts with jurisdiction over Glam Labs’ principal place of business in India will have jurisdiction, subject to mandatory rights that apply to you.
15. Changes
We may update these Terms. We will publish the effective date and give reasonable notice of material changes when required. Continued use after changes take effect constitutes acceptance.
